When you make an enquiry or booking, you agree to provide accurate, current and complete information, including the student's name, age or year group, subject needs and availability. You are responsible for keeping this information up to date and for informing us promptly of any changes that may affect the tutoring arrangement.
If you are booking on behalf of a child, you confirm that you are the child's parent or legal guardian, or that you otherwise have the authority to arrange tutoring and consent to the processing of the child's information as described in our Privacy Policy.
4. Our services
4.1 What we offer
We provide one to one and small group online tutoring across a broad range of subjects and levels, including primary and secondary education, GCSE, A Level, 11 Plus, 13 Plus, Key Stage 3, resits, and university admissions tests such as UCAT, LNAT, MAT, ESAT and TMUA. Lessons are delivered remotely by tutors matched to each student's subject, level, exam board and learning needs.
4.2 Tutor matching
Once you submit an enquiry, our team reviews the information provided and selects a tutor whose subject expertise, experience, teaching style and availability best fit the student's needs. While we take care in matching students with a suitable tutor, we cannot guarantee that any particular tutor will be available at all times, and matches may occasionally be adjusted where needed to maintain quality of teaching.
4.3 Free trial lesson
New clients are offered a complimentary thirty minute trial lesson with a matched tutor. The trial lesson carries no obligation to continue with paid tutoring, and either party may decide not to proceed after the trial. If you wish to continue, regular paid lessons can then be arranged around your schedule.
4.4 No long term contracts
We do not require clients to sign up to long term contracts or pay for lesson packages upfront. Lessons are arranged on a rolling basis and can be adjusted, paused or stopped in line with the cancellation terms set out below.
5. Fees and payment
Tutoring rates depend on the subject, level and type of lesson booked, and current rates will be confirmed to you before any paid lesson is arranged. Our published starting rate is from twenty six pounds per hour for one to one lessons, and rates for group tutoring are available on request by contacting us directly.
Fees are payable in advance of the lesson or lesson block, using the payment method agreed with our team, unless we have separately agreed a different arrangement with you in writing. Any exam registration fees, textbooks, or third party materials recommended by a tutor are the responsibility of the client unless otherwise agreed.
We reserve the right to change our pricing from time to time. Any change will not affect lessons that have already been booked and paid for, and we will give you reasonable notice before any new rate applies to future bookings.
6. Cancellations, rescheduling and missed lessons
We understand that plans change, and we aim to keep scheduling as flexible as possible. If you need to cancel or reschedule a confirmed lesson, please give us as much notice as you can, and in any event at least twenty four hours before the scheduled start time, by contacting your tutor or our team directly.
Lessons cancelled or rescheduled with at least twenty four hours notice will not be charged, and any fees paid will be credited towards a future lesson. Lessons cancelled with less than twenty four hours notice, or where a student does not attend a scheduled lesson without notice, may be charged in full, since the tutor's time has been reserved specifically for that session.
If a tutor needs to cancel or reschedule a lesson, we will let you know as early as possible and offer an alternative time or, where appropriate, a suitable replacement tutor. No fee is charged for lessons cancelled by us or by the tutor.
7. Refunds
Where a lesson has been paid for and is cancelled by us or by the tutor and cannot reasonably be rescheduled, we will offer a credit towards future lessons or, where you prefer, a refund of the amount paid for that lesson. Refund requests relating to any other circumstances will be considered individually, and we will respond to any request within a reasonable time after you contact us at [email protected]. This clause does not affect any statutory rights you may have as a consumer under UK law.
8. Tutor selection and conduct
Every tutor who joins our panel goes through a thorough selection process. We accept a small proportion of applicants, assess subject knowledge, teaching ability and communication skills through interview, and require every tutor to hold a degree from a recognised university and to pass an enhanced Disclosure and Barring Service check and a safeguarding assessment before they are permitted to teach any student.
While we take considerable care in selecting and matching tutors, tutors are engaged by Eximus Education to deliver lessons on our behalf, and we retain responsibility for the standard and conduct of the service you receive. If you have any concern about a tutor's conduct or the quality of a lesson, please raise it with us as soon as possible so that we can look into it and, where appropriate, offer a replacement tutor or other resolution.
9. Responsibilities of clients and students
To help lessons run smoothly, clients and students agree to the following.
-
Attend scheduled lessons on time and give appropriate notice of any changes.
-
Provide a reasonably quiet space with a stable internet connection, and a device suitable for video calls, for the duration of each lesson.
-
Where the student is a child, ensure that an appropriate adult is reasonably available nearby during online lessons, in keeping with normal safeguarding practice for online learning.
-
Treat tutors and Eximus Education staff with courtesy and respect, and refrain from any abusive, threatening or discriminatory behaviour.
-
Use any lesson materials provided for personal study purposes only, and not for commercial redistribution.
We reserve the right to suspend or end the provision of services, without a refund for lessons already delivered, where a client or student's conduct is abusive, unsafe or otherwise seriously breaches these terms.
10. Safeguarding and child protection
The safety and wellbeing of every student is something we take seriously. All tutors working with children have passed an enhanced DBS check and a safeguarding assessment before being matched with any student. Lessons are conducted online through our platform, and we ask parents and guardians to remain reasonably contactable and aware of their child's lessons.
If you have any safeguarding concern relating to a lesson, a tutor, or a student, please contact us immediately at [email protected] so that we can investigate and take appropriate action.
11. Intellectual property
All content on our website, including text, graphics, logos and course materials prepared by Eximus Education, is owned by or licensed to Eximus Education and is protected by copyright and other intellectual property laws. Worksheets, notes or other materials that a tutor prepares specifically for a student during tutoring remain the intellectual property of Eximus Education or the tutor, and are provided to the student for personal educational use only.
You may not copy, reproduce, distribute or create derivative works from any part of our website or lesson materials for commercial purposes without our prior written consent.
12. Confidentiality
Both parties agree to keep confidential any personal or sensitive information shared in connection with the tutoring relationship, including information about a student's learning needs, and to use it only for the purpose of providing or receiving the services described in these terms, in line with our Privacy Policy.
13. Limitation of liability
We take pride in the quality of our tutoring and the care we take in matching students with suitable tutors. However, tutoring outcomes depend on many factors outside our control, including a student's own effort, attendance and preparation, and we cannot guarantee specific grades, exam results or admission outcomes.
To the fullest extent permitted by law, Eximus Education's total liability to you in connection with the services will not exceed the total fees paid by you for the specific lessons giving rise to the claim in the twelve months before the claim arose. We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited under English law.
We are not responsible for any failure or delay in providing the services caused by circumstances outside our reasonable control, including internet or technology failures, illness, or events of force majeure.
14. Termination
You may stop booking lessons with us at any time, subject to the cancellation and payment terms already set out above for any lessons already scheduled. We may suspend or terminate the provision of services to you where you seriously or repeatedly breach these terms, where continuing the relationship would pose a safeguarding risk, or where we reasonably believe it necessary to protect our tutors, staff or other students.
15. Complaints
If you are unhappy with any aspect of our service, please contact us at [email protected] with details of your concern. We aim to acknowledge complaints promptly and to work with you towards a fair resolution, which may include a replacement tutor, a lesson credit, or another appropriate remedy depending on the circumstances.
16. Changes to these terms
We may update these terms and conditions from time to time to reflect changes in our services or in the law. The latest version will always be available on our website, and where changes are significant we will take reasonable steps to bring them to your attention. Continued use of our services after any update means you accept the revised terms.
17. General
If any provision of these terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these terms will not be considered a waiver of that right. These terms, together with our Privacy Policy, represent the entire agreement between you and Eximus Education in relation to the services described here.
18. Governing law
These terms and conditions are governed by the laws of England and Wales, and any dispute arising in connection with them will be subject to the exclusive jurisdiction of the courts of England and Wales.
